1. About these terms

These terms govern the relationship between Endure Decks (ABN 64 674 619 553) and clients engaging our decking and outdoor construction services in Western Australia. By accepting a quote or engaging our services, you agree to these terms.

2. Quotes and pricing

Quotes are valid for 30 days from the date of issue. Fixed-price quotes cover the scope of work specified in the written proposal. Variations to scope requested after contract execution may result in additional charges, agreed in writing before work proceeds.

3. Pre-construction agreement

A pre-construction agreement (PDA) fee is required before design, engineering, or council submission work commences. This fee is non-refundable if the client cancels the project after design work has begun.

4. Payment terms

Payment is structured in progress stages as outlined in your proposal, typically:

  • PDA fee on agreement
  • Deposit on contract execution
  • Progress payment on frame completion
  • Progress payment on board completion
  • Final payment on practical completion

Invoices are due within 5 business days. Late payments may attract interest at 10% per annum.

5. Warranty

All decking installations by Endure Decks carry a 7-year structural warranty covering defects in workmanship and installation. This warranty is in addition to, and does not limit, any rights you have under the Australian Consumer Law.

Manufacturer warranties on materials (composite boards, hardware) are passed through to the client and are governed by the manufacturer's terms. Timber products are subject to natural variation in colour and grain; this is not a defect.

6. Site access and client obligations

The client is responsible for ensuring safe and clear site access during construction. Any delays caused by restricted access, missing approvals, or failure to make progress payments may result in revised completion dates.

7. Council approvals and permits

Where council building permits are required, Endure Decks will advise during the proposal stage. Permit fees are the responsibility of the client and are not included in the build contract price unless explicitly stated.

8. Dispute resolution

In the event of a dispute, both parties agree to attempt resolution through direct negotiation in the first instance. If unresolved, disputes may be referred to the Building Commissioner of Western Australia or the State Administrative Tribunal (SAT).

9. Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any right or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, that cannot be excluded, restricted, or modified by agreement.
